The Site is published by Maison Boinaud S.A.S., a French company with a share capital of €13,719,878.20, headquartered at Angeac-Champagne – 16130 – 140 rue de la Bonne Chauffe – France, registered with the RCS of Angoulême under number 907 120 216 (hereinafter referred to as “Maison Boinaud”). The use of the Site by any person (“the User”) is governed by these general terms of use (the “General Terms of Use”). The General Terms of Use define the terms and conditions of access and use of the Site. By accessing the Site, you unreservedly accept the application of the General Terms of Use and the applicable clauses regarding personal data protection (see the Privacy Policy). Maison Boinaud may update the General Terms of Use and the Privacy Policy at any time. Users are encouraged to review them regularly. To access the Site, you must have reached the legal age for consuming and/or purchasing alcohol according to the legislation in your country of residence (the highest applicable age being taken into account). If no legal age exists in your country of residence, you must be at least 21 years old to access the Site.

In particular, the User is prohibited from:

– Uploading, posting, emailing, or transmitting any element containing software viruses or computer programs designed to interrupt, destroy, or limit the functionality of any software or telecommunication equipment;
– Disrupting or interrupting the operation of the Site;
– Undermining the operation of the Site, including by exposing it to a virus, overloading the bandwidth;
– Accessing information that is not intended for them;
– Engaging in illegal activities or any other activities that could harm the rights of Maison Boinaud, its suppliers, service providers, retailers, advertisers, or others;
– Uploading, posting, emailing, or transmitting any illegal, harmful, defamatory, offensive, racist, vulgar, obscene, threatening, violent, immoral content, infringing on privacy, or shocking, particularly from a racial or ethnic perspective;
– Emailing or transmitting any Site content to people who are not of legal age to consume alcohol in their country of residence.

If necessary, Maison Boinaud reserves the right to terminate the User’s access to the Site at any time for non-compliance with the General Terms of Use and/or any other supplementary document, without prejudice to Maison Boinaud’s right to claim damages.

1.3 USER-PUBLISHED CONTENT
If applicable, Site users are solely responsible for the content they post on the Site and the consequences of its distribution, publication, transfer, or availability. Maison Boinaud declines all responsibility for the content posted on the Site, within the limits of the applicable regulations. However, Maison Boinaud reserves the right to determine whether the content posted by users complies with the requirements specified in the General Terms of Use and may remove any content that violates these General Terms of Use.
The User agrees that Maison Boinaud may freely use, without any restriction or limitation in time and free of charge, the content posted on the Site not only for its dissemination on the Site but also for its dissemination and reproduction on any other medium for the promotion and advertising of Maison Boinaud, its products, and/or its services.

PROTECTION OF SITE CONTENT

Maison Boinaud ensures the protection of any personal data transmitted by the User of the Site. The Privacy Policy outlines the provisions in place to ensure the proper handling of data. The collection, processing, use, transmission, storage, and protection of the User’s personal data are governed by the Privacy Policy.

LIABILITY

Maison Boinaud strives to ensure the accuracy and update of the information it provides on the Site. However, Maison Boinaud cannot guarantee the accuracy, precision, or completeness of the information made available to Users on the Site. APPLICABLE LAW AND JURISDICTION

Any dispute concerning the Content and use of the Site falls under the exclusive jurisdiction of the competent court of the Bordeaux Court of Appeal, including in cases of third-party claims, multiple defendants, summary proceedings, or injunctions.

COOKIES AND SITE NAVIGATION

Maison Boinaud’s web server automatically collects standard information such as the User’s IP address, browser type, operating system, access times, etc. The site www.heriose.com does not use cookies to customize the Web page content. Cookies are small electronic files that a website can transfer to a user’s hard drive to identify the user and personalize their use of the website. All information collected indirectly will only be used by Maison Boinaud to monitor the volume, type, and configuration of traffic using this site, to develop the design and layout of the website, and for other administrative and planning purposes.
